3. Intellectual Property

3.1 Our Content

All content on MrKottu.lk, including but not limited to text, articles, recipes, guides, reviews, graphics, logos, icons, images, photographs, audio clips, video clips, data compilations, page layouts, underlying code, software, and the overall design and arrangement of the Site (collectively, "Content"), is the property of MrKottu.lk or its content suppliers and is protected by Sri Lankan and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3.2 Trademarks

The MrKottu.lk name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MrKottu.lk. You may not use these marks without our prior written permission. All other names, logos, product and service names, designs, and slogans appearing on the Site are the trademarks of their respective owners.

3.3 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any Content on the Site except as expressly permitted in these Terms, without the prior written consent of MrKottu.lk. Specifically, you may not:

4.1 Submissions

MrKottu.lk may allow you to submit content through our contact form, including but not limited to recipe suggestions, restaurant recommendations, feedback, comments, and other communications (collectively, "User Content"). By submitting User Content to us, you grant MrKottu.lk a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media or format, whether now known or hereafter developed, for any purpose, including but not limited to operating, promoting, and improving the Site.

4.2 Representations

By submitting User Content, you represent and warrant that:

  • You own or have the necessary rights, licenses, consents, and permissions to submit the User Content and to grant the rights described herein.
  • The User Content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or other rights of any third party.
  • The User Content does not contain any material that is defamatory, obscene, offensive, hateful, discriminatory, threatening, harassing, or otherwise unlawful.
  • The User Content is accurate and not misleading.
  • The User Content does not violate any applicable law or regulation.

4.3 No Obligation

We are under no obligation to use, publish, or respond to any User Content you submit. We reserve the right, but have no obligation, to review, monitor, edit, or remove any User Content at our sole discretion, for any reason or no reason, at any time, without notice to you.

5. Advertising

MrKottu.lk displays third-party advertisements, including advertisements served through Google AdSense and potentially other advertising networks. By using the Site, you acknowledge and agree that:

  • The Site may display third-party advertisements, including banner ads, text ads, display ads, video ads, and other forms of advertising.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MRKOTTU.LK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE.
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING RECIPES, NUTRITIONAL INFORMATION, RESTAURANT INFORMATION, OR OTHER MATERIALS.
  • WARRANTIES THAT THE RESULTS OBTAINED FROM THE USE OF THE SITE OR ANY CONTENT WILL BE ACCURATE, RELIABLE, OR SATISFACTORY.

No advice, information, or statement, whether oral or written, obtained from MrKottu.lk, through the Site, or through any Content shall create any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MRKOTTU.LK, ITS OWNERS, OPERATORS, DIRECTORS, EMPLOYEES, CONTRIBUTORS, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, goodwill, or anticipated savings.
  • Personal injury or property damage arising out of or in connection with your use of the Site.
  • Any unauthorized access to or alteration of your transmissions or data.
  • Any conduct or content of any third party on the Site.
  • Any injuries, illnesses, allergic reactions, or adverse effects resulting from the preparation or consumption of food based on recipes on the Site.
  • Any experiences at restaurants, food establishments, or businesses mentioned or reviewed on the Site.
  • Any other matter relating to the Site or these Terms.

THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE, OR OTHERWISE, EVEN IF MRKOTTU.LK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE EXCEED THE AMOUNT OF ONE HUNDRED SRI LANKAN RUPEES (LKR 100.00).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless MrKottu.lk, its owners, operators, directors, employees, contributors, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

  • Your violation of any third-party rights, including intellectual property rights, privacy rights, or publicity rights.

This indemnification obligation shall survive the termination of these Terms and your use of the Site.

10. Termination

We reserve the right, at our sole discretion, to terminate or suspend your access to the Site, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the courts located in Colombo, Sri Lanka, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to the exercise of jurisdiction over you by such courts and any objection to the venue of such courts.

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or to prevent irreparable harm.

12. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, such provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

13. Waiver

The failure of MrKottu.lk to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any right or provision under these Terms shall only be effective if it is in writing and signed by an authorized representative of MrKottu.lk. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and MrKottu.lk regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.

15. Changes to These Terms

We reserve the right to revise and update these Terms of Service from time to time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Site thereafter. We will indicate the date these Terms were last revised by updating the "Last Updated" date at the top of this page.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
